These Terms of Service (the “Terms”) govern your access to and use of the Agiliza mobile application, website, and related services (together, the “Platform”). Please read them carefully — by using Agiliza, you agree to be bound by them.
01 Agreement to these Terms
By creating an account, booking a service, or otherwise using the Platform, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use Agiliza. If you are using the Platform on behalf of a business, you represent that you are authorised to bind that business to these Terms.
02 The Agiliza service
Agiliza is a marketplace that connects customers seeking home services — such as cleaning, plumbing, beauty, repairs and more — with independent professionals (“Providers”) who offer those services. Agiliza facilitates discovery, booking, communication and payment between the two.
Agiliza is not a provider of the underlying services and does not employ Providers. Providers are independent third parties responsible for the services they deliver. We do not guarantee the quality, safety, or legality of any service booked through the Platform, although we take reasonable steps to vet Providers.
03 Eligibility & accounts
You must be at least 18 years old and able to form a legally binding contract to use Agiliza. When you create an account you agree to:
Provide accurate, current and complete information.
Keep your login credentials confidential and secure.
Be responsible for all activity that occurs under your account.
When you book a service, you enter into a direct agreement with the Provider. Prices are displayed in the app before you confirm and may include applicable taxes and service fees. Payment is processed securely in-app through our third-party payment partners; Agiliza does not store full card details.
By confirming a booking you authorise us to charge the selected payment method for the agreed amount, including any additional charges you approve for extra work performed.
05 Cancellations & refunds
You may cancel a booking through the app. Cancellations made within the free-cancellation window shown at checkout are refunded in full. Late cancellations or no-shows may incur a fee that is passed on to the Provider to compensate for reserved time.
If a service is not delivered as described, contact us within 48 hours and we will work with you and the Provider to reach a fair resolution, which may include a partial or full refund.
06 Service providers
If you register as a Provider, you additionally agree to:
Hold all licences, insurance and qualifications required by law for your services.
Describe your services accurately and honour the prices and availability you publish.
Deliver services professionally, safely and in line with applicable regulations.
Comply with our payout terms; Agiliza deducts an agreed commission from completed bookings.
07 Acceptable use
You agree not to misuse the Platform. In particular, you must not:
Use Agiliza for any unlawful, fraudulent or harmful purpose.
Circumvent the Platform to avoid fees or take bookings off-platform.
Harass, threaten or discriminate against other users or Providers.
Interfere with, disrupt, or attempt to gain unauthorised access to our systems.
08 Reviews & content
You may submit ratings, reviews and other content. You retain ownership of your content but grant Agiliza a non-exclusive, worldwide, royalty-free licence to use, display and distribute it in connection with operating and promoting the Platform. Content must be honest, lawful and free of offensive or infringing material. We may remove content that breaches these Terms.
09 Disclaimers & limitation of liability
The Platform is provided “as is” and “as available”. To the fullest extent permitted by law, Agiliza disclaims all warranties not expressly stated in these Terms. As a marketplace, we are not liable for the acts, omissions, or quality of work of independent Providers.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability arising from your use of the Platform is limited to the fees you paid to Agiliza in the three months preceding the event giving rise to the claim.
10 Suspension & termination
You may stop using Agiliza and close your account at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or where required by law. Provisions that by their nature should survive termination — including payment obligations, content licences and liability limits — will continue to apply.
11 Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email and update the “Last updated” date above. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
12 Governing law
These Terms are governed by the laws of Portugal. The courts of Lisbon have non-exclusive jurisdiction over any dispute, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
